The Supreme Court refused to ban cow
slaughter as that would amount to
judicial legislation and would
infringe on the roles,
responsibilities, and authority of the
Legislative bodies.
Disposing a petition by appellants from
Karnataka, the SC observed that while
cow slaughter was completed banned in
Coorg because the Kodavas were against
this practice, this ban was weakened
when they merged with the erstwhile
Mysore state. However, after its
merger with Mysore, a new legislation
called Mysore Prevention of Cow
Slaughter and Cattle Preservation Act
was enacted in 1964 that allowed the
slaughter of only bulls and buffaloes.
Therefore, they declined to ban the
slaughter of bulls and buffaloes. |
